Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of Feedback, including feedback.latentedge.io, the dashboard, the API, and the embeddable widget (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

3. The Service

Feedback lets you register one or more sites, obtain a publishable API key for each, embed a widget on your websites, and collect and manage feedback, feature requests, and bug reports from your visitors. We may add, change, or remove features over time.

4. Accounts and security

You are responsible for the information you provide and for keeping your login credentials secure. You are responsible for all activity under your account. Notify us promptly if you believe your account has been compromised.

5. API keys

API keys issued by the Service are publishable and are intended to be embedded in client side code. Protect each key by restricting it to the domains where you use it. You are responsible for activity associated with your keys, and we may rate limit or disable keys that show signs of abuse.

6. Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, deceptive, or infringing.
• Collect or store sensitive personal information through the widget, or use the Service to harass or harm others.
• Interfere with or disrupt the Service, attempt to bypass rate limits or security controls, or access the Service in an unauthorized way.
• Reverse engineer, resell, or misrepresent the Service except as permitted by law.
• Send spam or automated submissions through the widget or API.

7. Your content and responsibilities

You retain ownership of the feedback and other data you collect through the Service. You grant us a limited license to host, process, and transmit that data solely to provide and secure the Service.

You are responsible for the feedback collected on your sites. With respect to your visitors, you act as the data controller and you must provide any required notices, obtain any required consent, and comply with applicable privacy and data protection laws. 8. Plans and billing

The free plan supports a single site with one allowed domain. Paid plans add support for multiple sites and domains, billed monthly or annually. Plan features and prices are described on our pricing page and may change with notice.

Paid billing may not be active during early development. Where billing applies, fees are charged in advance and, except where required by law, are non refundable. You can stop using a paid plan at any time, and the change takes effect at the end of the current billing period.

9. Intellectual property

The Service, including its software, widget, and branding, is owned by LatentEdge and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as permitted here.

10. Third party services

The Service relies on third party providers such as Cloudflare for hosting, storage, email, and bot protection. Your use of the Service may also be subject to those providers terms. We are not responsible for third party services.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be uninterrupted, secure, or error free.

12. Limitation of liability

To the maximum extent permitted by law, LatentEdge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

13. Indemnification

You agree to indemnify and hold harmless LatentEdge from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

14. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for operational reasons. On termination, your right to use the Service ends. You may export or delete your data through the dashboard before terminating where possible.

15. Changes to the Service and Terms

We may update the Service and these Terms from time to time. When we make material changes to these Terms, we will update the date at the top of this page and, where appropriate, provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict of law principles. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
